Vehicle damaged by roofers. Anyone familiar with Kansas law?
So my landlord hired some roofers to replace the roof of my apt while I was away on military orders (5 weeks). I left my car parked in my driveway and came back to a broken windshield. Roofers contacted and they said they "protected the car" with pads under the tarp and are "not responsible for the damage."
I have to get this repaired via an insurance claim as I have to report to my next duty station in 24 hrs and am getting it repaired now. I won't be allowed entry to the base with a damaged windshield. So the question, what are my options? I live in KS but will be away until mid Nov. Insurance is covering it but I'd at the very least, like my deductible covered. Roofers provided this pic.

They're definitely liable. Also really easy to argue the fact that obviously their "padding" didn't do anything.
Also is that your tarp or their tarp? If it's yours, tell them to provide proof that the windshield was ever padded. If if it's theirs and they're claiming they padded it then they were obviously worried about potentially damaging it. Last edited by bizzlezx10r; 11-04-2019 at 12:44 PM. |
